Terms of Service & Acceptable Use Policy

1. Modification
   Spasie Media reserves the right to update this Policy at any time, and it will be immediately effective upon posting to our website, www.spasie.com. It is your responsibility as a client to stay current with updates made to this Policy.
2. Disclosure to Law Enforcement:
   We specifically prohibit the use of our service for illegal activities. Therefore, Subscriber agrees that the Company may disclose any and all subscriber information including assigned IP numbers, account history, account use, etc. to any law enforcement agent who makes a written request without further consent or notification to the Subscriber. In addition Spasie Media shall have the right to terminate all service set forth in this Agreement.
3. Services
   Spasie Media accepts no responsibility for damages induced to sites/servers by 3rd parties and by any kind of network or server attacks.
4. Domain Registration/Renewal Costs:
   Please note that fees payable for domain registration and renewal costs are non-refundable. Spasie Media accepts no responsibility for any typing errors (spelling mistakes) you make when ordering a domain name with us. Once a domain name has passed its expiry date there is no guarantee that we are able to renew the domain, additional charges might apply in these cases.
5. Payment:
   We will issue invoices on a standard monthly basis, (15 days before the due date) payment is due on the 1st or according to the due date on the invoice. Our current payment method is EFT (direct deposit).
6. Failure to Pay:
   The Company may temporarily suspend service upon the failure of customer to pay charges when due. The account will be reactivated as soon as the money is reflected in our account. We do not charge a reactivation fee. We currently suspend accounts that are overdue for 30 days or more.
7. SPAM and Unsolicited Commercial Email (UCE):
   Spasie Media takes a zero tolerance approach to the sending of Unsolicited Commercial Email (UCE) or SPAM over our network. Very simply this means that customers of Spasie Media may not use or permit others to use our network to transact in UCE. Customers of Spasie Media may not host, or permit hosting of, sites or information that is advertised by UCE from other networks. Violations of this policy carry severe penalties, including termination of service.If your actions have caused Spasie Media’s mail servers or Spasie Media’s IP address ranges to be placed on blackhole lists and other mail filtering software systems used by companies on the Internet, you will be assessed a R2500 charge to your account for administrative charges incurred to remove and protect mail servers and IP ranges.
8. Bandwidth Usage:
   Spasie Media measures bandwidth in megabytes (MB) based on downloads and uploads of all content types from your site. Should your bandwidth exceed the limit imposed by your hosting plan you will be billed at the rate applicable to your account, per MB. Spasie Media is the sole arbitrator of what constitutes bandwidth over usage and Spasie Media hereby has the right to charge your account in such instances.
9. The following scripts are banned from use on our hosting and may not be uploaded or run. Reasons for banning them include adverse effects on server load, invitations to hackers/spammers/criminal activity, etc.
   IRC egg drops
   BNC’s
   Proxy servers
   Mail bombers
   Torrent scripts
   Anonymous mailer
   IP spoofers
   Port scanners
   nph-proxy
   UBB (Ultimate Bulletin Board, all versions)
   Any script that uses & processes
   a massive number of flatfiles or large flatfile databases
10. Shared Hosting Resource Usage
    Eitehost’s hosting accounts operate on shared resources. Excessive use or abuse of these shared network resources by one customer may have a negative impact on all other customers. Misuse of network resources in a manner which impairs network performance is prohibited by this policy and may result in termination or suspension of your account without notice. You are prohibited from excessive consumption of resources, including CPU time, memory, disk space and session time. You may not use resource-intensive programs which negatively impact other customers or the performance of Spasie Media’s systems or Hosting. Spasie Media reserves the right to terminate or limit such activities.
11. System and Network Security:
    Users are prohibited from violating or attempting to violate the security of the Spasie Media Network. Violations of system or network security may result in civil or criminal liability. Spasie Media will investigate occurrences, which may involve such violations and may involve, and cooperate with, law enforcement authorities in prosecuting Users who are involved in such violations. These violations include, without limitation:Accessing data not intended for such User or logging into a server or account, which such User is not authorized to access. Attempting to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without proper authorization.Attempting to interfere with service to any user, host or network, including, without limitation, via means of overloading, “flooding”, “mail bombing” or “crashing”.Forging any TCP/IP packet header or any part of the header information in any e-mail or newsgroup posting.Taking any action in order to obtain services to which such User is not entitled.
12. Suspension of Service or Cancellation:
    Spasie Media reserves the right to suspend network access to any customer if in the judgment of the Spasie Media network administrators the customer’s server is the source or target of the violation of any of the other terms of the TOS or for any other reason which Spasie Media chooses. If inappropriate activity is detected, all accounts of the Customer in question will be deactivated until an investigation is complete.
13. Content
    Spasie Media’s current network does allow legal Adult Content on its servers but at the sole disgression of Spasie Media and its Network Operation Center. Child pornography is Prohibited and will result in suspension of service

    Sites containing or linking to material that may be considered detrimental to the public health, safety, or welfare. (Such as, but not limited to: Anarchists Cookbook, bomb making, weapon information, or anything else that may be considered detrimental or illegal.)
    Spasie Media does not allow, illegal software, music, torrents on their servers.

14. Backups
    Spasie Media does accounts backup’s monthly, and we only keep them for another month, however these backups are in no way guaranteed! Spasie Media does not provide any sort of compensation for lost or incomplete data in the event that backups do not function properly (even if the malfunction was due to negligence on Spasie Media’s part). We will do our best to ensure complete and accurate backups, but assume no responsibility for this duty. Always back your site up to your personal computer! We make no guarantees about the availability of backups.
15. Violations of the AUP will result in the following:
    Spasie Media reserves the right to suspend service to any Customer for violation of the AUP. Spasie Media will use reasonable care in notifying the Customer and in resolving the problem in a method resulting in the least amount of service interference as reasonably possible. Spasie Media reserves the right to immediate disconnection of service with no re-activation and without notice for violations of the AUP.
16. Responsibility for Content
    The customer is solely responsible for the content stored on and served on their hosting space.
17. Responsibilities of Customer
    When signing up for our services the customer must submit accurate and reliable contact details and promptly correct and update them, including: Customer’s full name, postal address, e-mail address, voice telephone number, and ID number; and, in the case that the Customer is an organization, association, or corporation: the name of authorized person for contact purposes. Spasie Media reserves to mark your account as fraud and deny services should any of your details fail during our fraud checks.

    Spasie Media is not responsible for any damages your business may suffer. Spasie Media does not make implied or written warranties for any of our services. Spasie Media denies any warranty or merchantability for a specific purpose. This includes loss of data resulting from delays, server downtime and any and all service interruptions caused by Spasie Media.

Privacy Statement

• Spasie Media has a policy to respect and protect the privacy of its customers and their information that is stored with Spasie Media. Spasie Media will only access and disclose information as necessary to comply with applicable laws and government requests, to provide the Spasie Media Services, to operate or maintain its systems or to protect itself or its customers.
